Résumé:

L’étude sur le ius cogens est un sujet de grand intérêt au sein du droit international public contemporaine. Néanmoins, l’analyse sur le conflit normatif entre normes impératives est presque inexistante. Cette thèse s’adresse à cette lacune spécifique dans la théorie générale du ius cogens. Ce type d’antinomie apparait dans l’application simultanée des normes impératives relatives aux droits humains, à l’interdiction du recours à la force, et au droit à l’autodétermination. La solution à ce problème juridique implique savoir comment des normes impératives contradictoires sont appliquées dans certaines circonstances de la réalité internationale. L’auteur met en avant l’utilisation des techniques de pondération («weighing and balancing»). Cette méthode est ainsi appliqué à deux cas d’antinomies entre normes impératives : (i) le conflit apparent entre l’interdiction de la force et l’interdiction des plus graves violations des droits humains et du droit international humanitaire, ainsi comme engendré par la notion « d’intervention humanitaire » ; et (ii) le conflit réel entre l’interdiction de la force et le droit à l’autodétermination dans un accord de paix israélo-palestinien hypothétique entrainant la cession des territoires occupées.

Abstract:

The study of ius cogens is a matter of great interest in public international law. Nonetheless, the inquiry into the potential collision between peremptory norms has been virtually nonexistent. This PhD dissertation puts forward a theory aimed at addressing this particular doctrinal gap. Antinomies between ius cogens norms may arise in the conflicting simultaneous application of the peremptory norms on human rights, on the non-use of force and on the right to self-determination. Solving these antinomies implies the determination of how existing norms of a ius cogens nature might be applied in situations in which there is a normative conflict between them. For that end, the author suggests the use of “weighing and balancing” techniques. This method is applied to two cases of antinomies between peremptory norms: (i) the apparent conflict between prohibition of the use of force and the prohibition of the most serious violations of human rights and international humanitarian law, as embodied in the notion of “humanitarian intervention”; and (ii) the real conflict between the prohibition of the use of force and the right to self-determination as embodied in a hypothetical Israeli-Palestinian peace agreement entailing the partial cession of occupied territories.
