JERP 5.2.2: International Law, Sovereignty and Global Governance

JERP 5.2.2 is one of the Jointly executed Research projects which is being coordinated by Universty of Geneva (Prof. N. Levrat) in co-operation with partners from Leiden University (Prof. N. Schrijver), VUB (Prof. S. Oberthur) and ULB (Prof. M. Telo).

Objectives

This research project shall concentrate on the articulation between international, European and national legal orders. This JERP will be built on the experience acquired by scholars on the EC/ national law relationship. It aims in this context at evaluating their individual and combined capacity to provide a framework for efficient governance.

Reflections and debates will also examine the legal position of the State and the EU (as an actor in the global system) within a system of global governance. An emphasis will be put on their capacity to produce a normative setting in cooperation or competition with each other, as well as with other competing actors in the process of global governance (International organisations, multinational corporations, NGOs).

Further, a specific concern will be devoted to the role of jurisdictions acting in different legal orders. An analysis of their various functions will constitute part of the common work.

Finally, the normative content of the “globalized legal order” and its capacity to produce an efficient governance will be evaluated.
