Résumé:

The prevailing concept of human rights universality in literature is based on the paradigm of liberal universality. Accordingly, human rights must be interpreted by prioritizing individualism, secularism, and autonomy in all domains of life and social institutions. Such an approach has been criticized for its lack of neutrality, reduced notion of viewpoint diversity, and top-down perspective. This research will demonstrate that the Universal Declaration of Human Rights of 1948 (UDHR) rather embodied a notion of pluralistic universality that also accepts communitarian or interdependent and religiously grounded worldviews, which is more compatible with non-Western cultures and some Western traditions. Therefore, this thesis proposes to rediscover the spirit of universality in diversity of the UDHR in the light of the right to self-determination, as a tool to encourage bottom-up approaches, intercultural dialogue, and global consensus as essential requirements to develop universally acceptable human rights standards by human rights mechanisms.
