Déjeuners-débats

Le CETEL lance une série de déjeuners-débats sur les thèmes qui sont au cœur de ses recherches : légistique, évaluation législative, recherche interdisciplinaire.

Ces déjeuners-débats sont donc ouverts non seulement aux juristes, mais aussi à tous les membres de la communauté universitaire qui s’intéressent aux relations entre le droit et les autres sciences.

Le restatement en common law : un instrument méconnu d'amélioration de la qualité du droit

Le prochain déjeuner-débat du CETEL portera sur un instrument légistique informel qui vise à systématiser le droit afin d’en améliorer sa qualité : le restatement.
Grandement méconnu des juristes continentaux, cet instrument sera présenté par un ponte de la discipline, le prof. Henry E. SMITH (Harvard Law School). La prof. Doris FORSTER (Université de Genève) lancera ensuite le débat en replaçant le restatement dans une perspective continentale plus familière des divers outils d’amélioration de la qualité du droit (codification, refonte, consolidation, évaluation, etc.).

Henry E. SMITH est professeur à la Harvard Law School. Il est un spécialiste du droit et de l'économie de la propriété. L'American Law Institute l'a nommé rapporteur pour un quatrième Restatement du droit de la propriété.

12h20-13h00	Restatement and the Common Law Prof. Henry E. SMITH , Harvard Law School Inspired by the need to manage complexity and uncertainty, the American Law Institute’s Restatements of the Law stand in a multifaceted relationship with the common law, in a fashion somewhat different from that of a statute. Restatements can potentially both accelerate legal reform and freeze the law in place. Drawing on notions of system that go beyond the purely deductive, this paper argues that a key consideration in the drafting of Restatements should be the architecture of the common law, including its conceptual structure. Restatements can seek an “architectural fit,” and in doing so they can strike a workable balance between certainty and flexibility.
